What is a “Short-Term Rental” (STR)?

In Pennsylvania, an STR is a residential property rented for fewer than 30 consecutive days. It may be a whole home, condo, lake house, accessory unit, or a hosted room.

Are STRs regulated in Pennsylvania?

Yes. STRs are regulated at the municipal (township/borough) level. Each locality can establish its own licensing, inspection, occupancy, noise, and parking rules.
There is currently no statewide STR licensing law—but the state is actively considering legislation.

How do I start a Short-Term Rental in Pennsylvania?

You must:

  1. Check your township/borough STR ordinance
  2. Apply for a local STR permit (if required)
  3. Meet safety and inspection requirements
  4. Register to collect lodging tax
  5. Follow all zoning, septic, and parking rules

If I buy a home in PA, can I STR it until I move in?

Yes, if zoning allows it. Some municipalities limit STRs based on zoning district, HOA restrictions, density, or primary residence status. Always confirm before buying.

How can I report an STR that is disturbing the neighborhood?

Contact your township zoning or code enforcement office.
For safety or noise emergencies, call local police non-emergency lines.

What taxes am I required to pay as an STR owner in PA?

STRs must collect:

  • County Hotel Occupancy Tax
  • State Sales Tax

If using a platform (Airbnb/VRBO), some taxes may be remitted automatically—but owners are still responsible for verification and any remaining filings.

Do I need to display a tax ID?

Some municipalities require visible posting of license and emergency contact information inside the home. Tax ID posting varies by township.

Do Pennsylvania Landlord-Tenant laws apply to STRs?

Generally, no. STRs are considered transient lodging, not long-term tenancy.
Eviction law, security deposit rules, and habitability statutes typically apply to stays 30+ days, not short-term vacation rentals.

What’s the difference between an STR and a Licensed Lodging Establishment?

A Licensed Lodging Establishment (e.g., hotel, inn, motel, B&B) is regulated under Pennsylvania health and commercial lodging codes.
An STR operates under residential zoning rules with municipal-level STR overlay regulations.
